Elythia Maternity – Terms and Conditions

1. About Us

Elythia Maternity is a membership platform operated by Elythia Limited, a private limited company registered in England and Wales (Company Registration No: 13145106). Our registered office is at 16 The Hawthorns, Ossett, Wakefield, West Yorkshire, WF5 0BH. Our registered director is Emanuela Rajakrishnen (known professionally as Emma Rajakrishnen).

Content is currently created and delivered by Emanuela Rajakrishnen. Elythia Limited reserves the right to engage additional team members, employees, contractors, or guest contributors in various capacities – including administrative support and content delivery – as the business develops. Any such individuals will be engaged at the sole discretion of Elythia Limited and in accordance with applicable law.

2. Acceptance of Terms

By registering for, accessing, or using the Elythia Maternity platform, you confirm that you have read, understood, and agree to be bound by these Terms and Conditions in their entirety, together with our Privacy Policy and Medical Disclaimer, each of which are incorporated herein by reference.

If you do not agree to these Terms, you must not use this platform.

 

3. Important Medical Notice

IMPORTANT: This platform does not provide medical advice. All content – including resources, live sessions, webinars, and 1:1 consultations – is for general informational and educational purposes only. It is not a substitute for professional medical advice from your midwife, GP, or obstetrician. In an emergency, call 999 or attend your nearest A&E immediately. Do not use this platform or any community group to seek urgent medical assistance.

 

By using this platform, you expressly acknowledge and accept this limitation. Elythia Limited shall not be liable for any harm arising from reliance on platform content in place of professional medical advice.

 

4. The Membership Service

Elythia Maternity provides a monthly subscription-based membership platform offering:

  • Evidence-based information and resources about pregnancy and maternity in the UK
  • Live sessions and webinars hosted by Emma Rajakrishnen or other approved contributors
  • Downloadable guides, checklists, and resources
  • Access to an optional private WhatsApp community group (see Section 11)
  • 1:1 consultation sessions, where booked and paid for separately

Elythia Limited reserves the right to modify, suspend, or discontinue any element of the service with reasonable notice, except where circumstances beyond our control prevent this (see Section 16: Force Majeure).

 

5. Membership & Payment

5.1 Subscription

Your membership is billed monthly from the date of sign-up. Payments are processed securely by Stripe via our Kajabi platform. By submitting your payment details, you authorise Elythia Limited to charge your chosen payment method on a recurring monthly basis.

5.2 Automatic Renewal

Your subscription renews automatically each month unless cancelled before your renewal date. You are responsible for keeping your payment details up to date. Elythia Limited accepts no liability for interrupted access resulting from failed payments due to outdated payment information.

5.3 Pricing

Current pricing is displayed on our website at the time of purchase. Elythia Limited reserves the right to amend pricing at any time. Where a price increase affects existing members, we will provide no less than 30 days’ written notice by email before the change takes effect. Continued use of the platform following notice of a price change constitutes acceptance of the new pricing.

 

6. Cancellation

You may cancel your membership at any time via your account settings on the Kajabi platform. Cancellation takes effect at the end of your current billing period. You will retain access to member content until that date. No partial refunds will be issued for unused time within a billing period.

To cancel, log into your account and follow the cancellation process. If you encounter any difficulty, contact us at [email protected] and we will assist you promptly.

 

7. Refund Policy

7.1 Monthly Membership – No Refund

All monthly membership payments are non-refundable. By completing your purchase, you expressly acknowledge and agree that:

  • You are purchasing access to digital content that will be made available to you immediately upon payment; and
  • You waive your statutory 14-day right to cancel under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013, on the basis that performance of the digital service begins immediately upon purchase.

This waiver is confirmed by your active agreement to these Terms and the acknowledgement checkbox presented at the point of checkout. If you do not wish to waive this right, do not complete your purchase.

7.2 Standalone Courses and Higher-Priced Products

Where Elythia Limited offers standalone courses or other higher-priced products in future, the applicable refund terms will be clearly stated at the point of purchase. Unless otherwise stated, a 7-day cooling-off period will apply from the date of purchase for such products.

7.3 Exceptional Circumstances

Elythia Limited retains absolute discretion to issue refunds in exceptional circumstances on a case-by-case basis. The exercise of this discretion in any individual case shall not constitute a waiver of this policy or create any precedent or obligation to do so in future cases.

 

8. Acceptable Use

By accessing the Elythia Maternity platform, you agree that you will not:

  • Use the platform for any unlawful purpose or in any way that violates applicable laws or regulations
  • Share your login credentials with any other person or allow any other person to access the platform using your account
  • Reproduce, distribute, republish, or commercially exploit any platform content without prior written consent from Elythia Limited
  • Upload, post, or transmit any content that is offensive, defamatory, harassing, harmful, or otherwise objectionable
  • Attempt to gain unauthorised access to any part of the platform or its underlying systems
  • Use the platform or any community group to seek or provide medical advice, emergency assistance, or clinical guidance
  • Engage in any conduct that could damage the reputation of Elythia Limited or its director

Elythia Limited reserves the right to suspend or terminate access to the platform, without refund, where a member is found to be in breach of this acceptable use policy.

 

9. 1:1 Consultations

Where 1:1 consultations are offered, these are booked and paid for separately from the membership. Consultations are informational and educational in nature only. They do not constitute a clinical appointment and do not create a midwife–patient or healthcare provider–patient relationship. Cancellation and rescheduling terms for individual consultations will be confirmed at the time of booking.

 

10. Live Sessions and Webinars

Live sessions and webinars are scheduled in advance and announced to members. Where a session is recorded, the recording will be made available within the content library. Elythia Limited reserves the right to reschedule, substitute a presenter, or cancel sessions. Where cancellation is within our control and reasonable notice cannot be given, we will endeavour to offer an alternative session. No refunds will be issued solely on the basis that a scheduled session is rescheduled or a presenter is substituted.

 

11. WhatsApp Community Group

Members may be invited to join an optional WhatsApp community group. Participation is entirely voluntary and is not a condition of membership. By joining the group, you agree that:

  • The group exists for community building, content feedback, and session announcements only
  • The WhatsApp group must not be used to seek or provide medical advice, raise urgent concerns, or as a crisis or emergency platform. If you have an urgent medical concern, contact your midwife, GP, or call 999
  • You will communicate respectfully at all times. Elythia Limited reserves the right to remove any member from the group for conduct that is harmful, offensive, or disruptive, without refund
  • Elythia Limited is not responsible for content posted by other members within the group
  • The group is not monitored in real time and messages may not receive an immediate response

 

12. Intellectual Property

All content on the Elythia Maternity platform – including written resources, videos, audio recordings, downloadable guides, webinar recordings, and all associated materials – is the intellectual property of Elythia Limited and is protected by copyright, database rights, and other applicable intellectual property laws.

Members are granted a limited, personal, non-exclusive, non-transferable licence to access and use content solely for their own private, non-commercial purposes during their active membership. This licence does not include the right to:

  • Copy, reproduce, distribute, or share content with any third party
  • Use content for any commercial purpose
  • Modify, adapt, or create derivative works from any content
  • Remove or alter any copyright or proprietary notices

Where future contributors create content for the platform, all intellectual property rights in such content shall vest in or be assigned to Elythia Limited, and members’ use of such content remains subject to the same licence terms above.

Any unauthorised use of platform content may result in immediate termination of membership without refund and may give rise to legal action.

 

13. Indemnity

You agree to indemnify, defend, and hold harmless Elythia Limited, its director, employees, contractors, and agents from and against any claims, losses, damages, liabilities, costs, and expenses (including reasonable legal fees) arising out of or in connection with:

  • Your use of or access to the platform
  • Your breach of these Terms and Conditions
  • Your breach of any applicable law or regulation
  • Any content you post or share via the platform or associated community groups
  • Any misuse of platform content or reliance upon it in circumstances where you have been advised to seek professional medical advice

 

14. Limitation of Liability

To the fullest extent permitted by applicable law, Elythia Limited shall not be liable for any indirect, incidental, special, consequential, or punitive loss or damage, including but not limited to loss of profits, loss of data, or loss of goodwill, arising out of or in connection with your use of or inability to use the platform.

Our total aggregate liability to you under or in connection with these Terms shall not exceed the total amount paid by you to Elythia Limited in the 12 months immediately preceding the event giving rise to the claim.

Nothing in these Terms shall limit or exclude our liability for death or personal injury caused by our negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be excluded or limited by English law.

Elythia Limited holds public liability insurance. Nothing in this clause shall be construed as limiting or excluding the cover provided under that policy where it applies.

 

15. Dispute Resolution

In the event of any dispute, complaint, or concern arising out of or in connection with these Terms or your use of the platform, you agree to contact us in the first instance at [email protected] and allow us a reasonable period of no less than 14 days to respond and seek to resolve the matter informally before pursuing any formal legal proceedings.

This clause does not affect your statutory rights as a consumer.

 

16. Force Majeure

Elythia Limited shall not be in breach of these Terms, nor liable for any failure or delay in performing any obligation under these Terms, where such failure or delay results from circumstances beyond our reasonable control, including but not limited to: illness or incapacity of key personnel, acts of God, pandemic or epidemic, failure of third-party platforms or services (including Kajabi or Stripe), internet or telecommunications failures, fire, flood, or other natural disaster, or any act of government or regulatory authority.

Where a force majeure event prevents us from delivering a service, we will endeavour to reschedule or offer an alternative where reasonably practicable. We will notify affected members as soon as reasonably possible.

 

17. Amendments to These Terms

Elythia Limited reserves the right to amend, update, or replace these Terms and Conditions at any time and without prior notice. This includes, without limitation, changes to our contact details, registered office address, pricing, refund policy, acceptable use policy, and any other provisions contained herein.

The current version of these Terms will always be published on our website, with the version date indicated at the top of this document. Where changes are material, we will endeavour to notify active members by email; however, it is your responsibility to review these Terms periodically. Your continued use of the platform following any update constitutes your acceptance of the revised Terms.

 

18. Severability

If any provision of these Terms is found by a court of competent jurisdiction to be invalid, unlawful, or unenforceable, that provision shall be deemed severed from the remainder of these Terms, which shall continue in full force and effect.

 

19. Entire Agreement

These Terms and Conditions, together with our Privacy Policy and Medical Disclaimer, constitute the entire agreement between you and Elythia Limited in relation to your use of the platform and supersede all prior agreements, representations, and understandings.

 

20. Governing Law and Jurisdiction

These Terms and Conditions are governed by and construed in accordance with the laws of England and Wales. Each party irrevocably submits to the exclusive jurisdiction of the courts of England and Wales to settle any dispute or claim arising out of or in connection with these Terms.
